1. General conditions
By placing an order, the buyer accepts the terms and conditions for the delivery of goods announced by the seller. The relations between the buyer and the seller are governed by these terms and conditions, which are binding on both parties. The conditions define and specify the rights and obligations of the seller and his customers and, in their current version, form the content of the purchase contract (on the supply of goods), or they are an integral part of it.The purchase contract can be concluded in the Czech language. The seller will deliver the goods based on an electronic, written or telephone order. The goods are sent to the territory of the Czech Republic, shipments outside the Czech Republic are handled individually.
2. Subject of contract
The subject of the contract are only the items explicitly mentioned in the purchase contract - order (hereinafter referred to as goods). The information about the goods that the seller obtained from the manufacturers is non-binding information. The seller undertakes to deliver to its customers:

The place of fulfillment is the seller's warehouse at Jateční 470, Řetenice, 415 01 Teplice. Or the address according to the customer's order.
4. Ordering goods, concluding a contract
The condition for the validity of an electronic, written or telephone order is to fill in all the data and requirements prescribed by the form. The order is a draft purchase contract. In the event that the seller does not require formal confirmation of the order by the buyer to conclude the purchase contract, the contract is created by the delivery of the goods itself. In individual cases (especially in the case of a higher total purchase price), the seller can reserve the creation of a contract by confirming the order with the buyer. In such a case, the seller is entitled to ask the buyer to confirm the order by e-mail, SMS message or by phone. If the seller refuses to authorize the order in the required manner, the order is considered invalid.
5. Price and payment
Offer prices listed on the website https://zeleny-sklenik.cz/ operated by the seller are valid at the time of ordering.All product prices listed in the online store are final, including VAT.The seller reserves the right to printing errors and price changes depending on changes in the supply conditions of manufacturers and suppliers. The purchase price will be considered paid only when the entire purchase price is credited to the seller's current account or paid in cash to the carrier upon delivery of the goods. In the event of non-compliance with any payment deadline, the buyer is obliged to pay the seller late fees from the value of the amount not paid on time in the amount of 0.05% for each day of delay. The seller reserves the right of ownership to the goods until full payment of the purchase price. The invoice or delivery note issued on the basis of the purchase contract between the seller and the buyer is also a tax document. Acceptance of the goods by the buyer is only possible after full payment, unless otherwise agreed. The price of the goods may include a fee for sending the goods cash on delivery according to the valid price list of the Czech Post.
6. Delivery time
The delivery period starts from the date of receipt/authorization of the binding order, subject to the receipt of all documents that are necessary for timely processing of the delivery. If the goods are in the seller's or his supplier's warehouse, the seller undertakes to ship the goods within the delivery date specified for the relevant product on our website. The delivery period will be extended proportionately to the circumstances if the delay is caused by force majeure or circumstances beyond the fault of the seller such as off-season sales. If it is an important order, the buyer requests written confirmation of the order from the seller. In the event that the ordered goods cannot be delivered by the relevant delivery date, the seller will announce the expected delivery date or offer another comparable product. In that case, however, it will require the consent of the buyer. The delivery period is considered to have been fulfilled on time if the goods are ready at the place of fulfillment for delivery no later than the last day of the agreed or additionally agreed delivery period. If the seller is unable to send the goods to the customer by the given date, he is obliged to return without undue delay all funds spent by the customer for the current order - purchase contract to his account.
7. Traffic conditions
7a. Delivery by the manufacturer (our company)
We provide transport with our own trucks. The buyer is obliged to properly take over the goods from our driver, check the integrity of the packaging, the number of packages and, in the event of any defects, notify the manufacturer immediately. The proof of sale is included in the package. The package size is approx. 1x3m according to the size of the greenhouse.
7b. Custom pick up
Private collection can be made directly at the seller's premises at Jateční 470, Řetenice, 415 01 Teplice. It is best to agree on the date of your own pick up by phone.
7c. Professional installation by the seller
The seller offers professional assembly of the products by its own trained fitters on a pre-prepared base, which the buyer handles himself. The base of the greenhouse must be suitable in terms of dimensions and construction readiness. The dimensions of the buyer's base can be found on price lists, brochures and for each greenhouse on the website https://zeleny-sklenik.cz/. If, during the installation of the greenhouse by our company, it is discovered that the foundation of the greenhouse does not meet our requirements in terms of construction readiness or the dimensions of the foundations, to such an extent that this fact does not allow installation by our installers at the pre-arranged date and time, the buyer is responsible for the costs of re-transportation and to pay the fitters' work beyond the price of the greenhouse, in the amount of 15% of the total price of the product sold.
8. Warranty, complaints, returns
The seller provides a legal guarantee for the quality and completeness of the delivery. If the buyer discovers damage to the package during delivery, he must notify the carrier of this fact. If the buyer discovers defects after unpacking the shipment, he must always notify the seller of these facts in writing without undue delay, but no later than 3 days after receiving the goods. The buyer is obliged to check the completeness and integrity of the glass for the greenhouse or conservatory immediately upon receipt, to resolve any discrepancies immediately with the driver. The construction of the greenhouse must be checked no later than 30 days after acceptance, later claims of completeness will not be taken into account. The complaint must contain the date of delivery of the goods, the number of the delivery note or invoice, the name of the product, the claimed quantity, a description of the defect and a proposal for handling the complaint. If the incompleteness of the delivery of a greenhouse or other product is complained of, the exact designation of the missing position according to the packing list (numerical and verbal) must also be indicated, and a delivery note or invoice must be attached to the complaint (can also be sent in a copy or sent by fax). Complaints cannot be made by phone. The seller is obliged to comment on the complaint within 10 working days from the day of its receipt. The return of the goods by the buyer is possible without giving a reason within 30 days after receiving the shipment. The buyer can return the entire shipment if it is complete and undamaged. Together with the goods, the buyer must also send back the tax document/invoice to the seller, which will be canceled by the seller. The buyer can also return part of the shipment within 30 days of receiving the goods. Goods to be returned must be in intact and undamaged packaging. When returning part of the shipment, the buyer must pay the price of the entire shipment, part of the price for the returned goods will be returned by the seller to the buyer immediately after the complaint has been processed, within 14 days at the latest. If, by returning part of the shipment, the value of the ordered goods falls below the limit for free shipping, the buyer will be charged for shipping. The cost of transporting the returned goods to the seller is paid by the buyer.
9. Out-of-court settlement of disputes
1. The out-of-court settlement of consumer disputes arising from a purchase contract is the responsibility of the Czech Trade Inspection, with registered office at Štěpánská 567/15, 120 00 Prague 2, ID number: 000 20 869, internet address: https://adr.coi.cz/cs. Online Dispute Resolution Platform located at http://ec.europa.eu/consumers/odr can be used to resolve disputes between the seller and the buyer from the purchase contract.

10. Final Provisions
These terms and conditions apply in the wording stated on the seller's website on the day the electronic order is sent, unless otherwise agreed in writing between the participants. By sending an electronic order, the buyer unreservedly accepts all provisions of the terms and conditions in the wording valid on the day the order is sent, as well as on the day the order is sent, the amount of the price of the ordered goods (including possibly shipping and transport costs) indicated in the price list on the website, if not in demonstrably agreed otherwise in a specific case. The buyer is irrevocably bound by the sent order (draft purchase contract) for the period specified for the delivery of the goods. The participants have expressly agreed in accordance with Section 262 paragraph 1 of the Commercial Code that, unless the terms and conditions expressly provide otherwise, their rights and obligations are governed by the Commercial Code, especially Section 409 et seq.
These General Terms and Conditions are valid and effective from 1 December 2022 and cancel the previous version of the General Terms and Conditions. The seller reserves the right to change these GTC without prior notice.
